Disputes arise periodically between commercial insurance companies and their policyholders. Most are resolved to the satisfaction of the parties and without the need for litigation, but sometimes legal action is initiated with claims of bad faith on behalf of the insurance carrier. This session will provide a primer on what constitutes bad faith and the potential applicability to claims disputes between captive insurance companies and reinsurers.
